1. Acceptance of Terms

By accessing or using ShortsIntel.com (the "Service"), you agree to be bound by these Terms of Service (the "Terms"). If you do not agree to these Terms, you may not access or use the Service.

2. Eligibility & Account Registration

You must be at least 13 years old to use the Service. When you create an account you must provide accurate information and keep it up to date. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

3. Your Content

You retain all rights to the content you save to ShortsIntel ("User Content"). By uploading or saving User Content, you grant ShortsIntel and members of your team a worldwide, non-exclusive licence to host, display, process and copy that content solely to operate and improve the Service. You represent and warrant that you have the necessary rights to upload the content and that doing so does not infringe any third-party rights.

4. Intellectual Property

The Service, including our software, design, trademarks and logo, are owned by ShortsIntel and protected by intellectual-property laws. Except as expressly permitted, you may not copy, modify, distribute, sell or lease any part of the Service.

5. API Data: Permitted and Prohibited Uses

The ShortsIntel Intelligence API returns two kinds of material: raw records — public posts, captions, public metrics, public profile fields and comment text as published on TikTok, Instagram and YouTube — and derived output, which is what ShortsIntel computes from those records, including normalised structures, Intelligence objects, baselines, Scores, Snapshots, Change Reports and Digests.

Derived works are permitted. You may analyse, transform, combine and build on the API output, and you may distribute and commercialise the results — reports, dashboards, scores, recommendations, editorial analysis and other products whose value comes from your own work on top of the output — including to your own customers and to end users of your agent or application. You own what you create this way.

Reselling the raw data is not permitted. You may not:

• resell, sublicense, redistribute or otherwise make available the raw records or bulk API output as a data product, feed, export or dataset, whether for a fee or free of charge;
• republish raw records in bulk, or mirror, replicate or reconstruct the ShortsIntel corpus or any substantial part of it, including by systematic enumeration of the API;
• use the API or its output to build, train or operate a substitute for the Service, or a competing short-form video data service;
• use the output to identify, target, profile, score or make decisions about individual people, including creators and commenters, or to enable anyone else to do so;
• remove, obscure or misrepresent the provenance of data obtained through the Service where you are permitted to display it.

Incidental display of individual raw records in your own product — quoting a caption, showing a thumbnail, citing a metric to support an analysis — is permitted and is not "bulk" republication.

Upstream restrictions pass through. Some raw data reaches ShortsIntel through third-party providers, including ScrapeCreators, and through the platforms' own surfaces. Where those providers or platforms impose restrictions on the use, retention or redistribution of that data, those restrictions apply to you as well, and you agree to comply with them. If an upstream restriction and these Terms conflict, the more restrictive applies.

Accuracy. The Service reports public data and computations over it. Metrics change, platforms remove content, and enrichment is produced by AI models. Output may be incomplete or wrong, and coverage for some platforms is explicitly marked as partial. You are responsible for verifying anything you rely on.

6. Prohibited Conduct

• Reverse engineer, decompile or otherwise attempt to discover the source code of the Service;
• Upload content that is unlawful, harassing, defamatory, obscene or otherwise objectionable;
• Infringe or violate intellectual-property or privacy rights of others;
• Use bulk output from the Service to build, train or operate a substitute for it, or to reconstruct its corpus (see Section 5, which governs what you may and may not do with API data);
• Introduce malware or interfere with the proper working of the Service.

7. AI-Generated & Third-Party Content

AI-generated outputs are provided "as is" and may be inaccurate or incomplete. You are responsible for reviewing any AI-generated suggestions before use. ShortsIntel is not liable for decisions made or actions taken based on such content.

8. Subscription, Billing, Credits & Refunds

Certain features require a paid subscription. Subscriptions are sold through Lemon Squeezy, which acts as merchant of record. Fees are charged in advance on a recurring basis until you cancel. You may cancel at any time.

Intelligence API usage is paid from a prepaid balance. Balance top-ups are sold through Polar (polar.sh), which acts as merchant of record: Polar processes the payment, issues the invoice or receipt, and collects any applicable sales tax or VAT on top of the amount you add. Your balance is credited with the amount before tax.

Payments are non-refundable except as required by law. The payment provider's own terms also apply to your purchase.

The Intelligence API is prepaid rather than subscribed. You add credit to a balance held in US dollars and each operation is charged against it at the price published in the documentation at the time of the call. Top-ups start at $10. Operations that fail are not charged; operations that partially complete are charged only for the items delivered; results served from cached data are charged at a reduced rate. Before an operation starts, your balance is checked against its quoted price, and an operation the balance will not cover is refused without charge. If your balance falls while a multi-item operation is running, the items it completed are charged in order up to your remaining balance, the rest are not delivered, and an operation that could not pay for any of its work is not charged. Your balance never goes below zero. Credit is not a deposit, does not earn interest, and is redeemable only against use of the Service. Any promotional or starter credit expires as stated when it is granted.

9. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms. Upon termination your right to use the Service will immediately cease, but Sections 3–13 will survive.

10. Disclaimer of Warranties

The Service is provided on an "as-is" and "as-available" basis. ShortsIntel disclaims all warranties of any kind, whether express or implied.

11. Limitation of Liability

To the maximum extent permitted by law, ShortsIntel will not be liable for indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenue, arising out of or related to your use of the Service.

12. Indemnification

You agree to indemnify and hold ShortsIntel harmless from any claim or demand arising out of your violation of these Terms or your User Content.

13. Governing Law

These Terms are governed by the laws of Australia, without regard to conflict of laws principles. All disputes will be resolved in the courts of New South Wales.

14. Changes to Terms

We may modify these Terms at any time. Material changes will be announced via email or on our website. Continued use of the Service after the changes constitutes acceptance.
